The Village of Old Brookville is part of the Unified Court System of the State of New York. The Village Court is responsible for handling judicial proceedings concerning Vehicle and Traffic violations that occur within the Village, along with violations of Local Village Laws.
How to Respond to a Summons: In Person or By Mail
- In Person: You may appear in person on the Court date, which is listed below the Court’s address on the Summons, and enter your plea of guilty or not guilty.
- By Mail: You may return your plea to the Court by mail or email. You have the option to plead either guilty or not guilty by checking the correct response on Section A – Plea of Guilty or Section B – Plea of Not Guilty. Please note that some guilty pleas may be rejected by the Court.
*PLEASE NOTE THAT NO PLEAS WILL BE ACCEPTED VERBALLY OR OVER THE PHONE. ALL PEAS MUST BE IN WRITING – UNLESS YOU ARE APPEARING IN PERSON IN COURT.
All Village Ordinances must appear in Court on the date listed on the Summons.
Pleas of Not Guilty: If you are mailing or emailing your not guilty plea before the court date listed on the summons, you do not have to appear in court on that court date. You will receive a letter from the Court scheduling you for a conference with the Village Prosecutor on the next available court date. However, if you are pleading not guilty and wish to keep the original court date, you MUST make that clear when you are returning the summons.
You must fill out and sign Section B – Plea of Not Guilty on the ticket(s). Please make sure to write your name as it appears on the ticket. If your name is incorrect on the ticket, you must notify the Court as soon as possible. If your address has changed and is not the same as what is listed on the summons, you must provide your new address.
Mail the ticket(s) to: Old Brookville Village Court, 201 McCouns Lane, Old Brookville, NY 11545 or you may email it to me at courtclerk@oldbrookville.gov.
To Plead Not Guilty in Person: If you chose to appear in court and plead not guilty in person, you must appear on the date listed on the summons. You will have a conference with the Village Prosecutor and then appear before the Judge.
Pleas of Guilty: You may plead guilty by mail or email to some offenses. You may NOT plead guilty if you are charged with certain violations and all misdemeanor charges. By pleading guilty by mail or email, you do not have to appear in court.
Please note that The Court may reject your guilty plea, and you will be required to appear in person on the next available court date.
By pleading guilty by mail, you must fill out and sign Section A – Plea of Guilty on the ticket(s). Follow the same instructions as listed above – providing correct name and current address.
Mail the ticket(s) to Old Brookville Village Court at the address listed above. Once received, the Court will notify you of the fine(s) due by mail.
*Please note that by Pleading Guilty to a Charge, you waive your right to a trial, and you are subject to sentencing by the presiding Judge. However, you may withdraw, with the Court’s permission, your plea of guilty at any time PRIOR to sentencing and then exercise your right to a trial.
COURT NIGHT: Court is held once a month on a Thursday night – unless otherwise noted as some dates may be subject to change. Do not come to court unless directed to do so.
- The Court opens at 5:30 pm. Do NOT arrive more than 15 minutes prior to your scheduled court time. For all court appearances, you MUST have a scheduled court date.
- You will be required to sign in before entering the courtroom and you MUST sign in with your name as it appears on your ticket.
- You will be required to fill out a Contact Information Sheet.
- If an interpreter other than Spanish is required, you MUST contact me prior to your court date so arrangements can be made.
- When appearing in Court, please dress appropriately. Suits are not required.
- When in the Courtroom, phones must be silenced.
Failure to appear in court and/or failure to contact the Court may result in a license/registration suspension by the Department of Motor Vehicles.
For Insurance Violations – 319-1U: Once a ticket has been issued, due to NY State Law, Insurance ID Cards are not accepted as proof of insurance. Declaration Pages and a letter from a Broker will not be accepted as proof of insurance. The ONLY proof of insurance the Court will accept is a letter from your insurance company, on their letterhead, stating that you had valid insurance without any lapse in coverage. The letter must include the following: make, model, color, Vin number, plate number, effective dates of coverage and it must state that on the date that you received your ticket you had valid insurance without any lapse in coverage.
**ALL PROOF MUST BE PROVIDED IN COURT ON YOUR SCHEDULED COURT DATE OR YOU MAY EMAIL IT TO ME PRIOR TO COURT**
Paying Fines: Fines can be paid the night of court, or the Court will give you time to pay.
How to Pay Fines: Fines may be paid in cash, but you MUST have the exact amount or by credit/debit cards (Visa, MasterCard, Discover or American Express) either in person or over the phone. For all credit and debit card transactions, there is a 2.99% bank convenience fee.
Fines may also be paid by Attorney Checks, Postal Money Orders or a Bank Certified Check. Payment should be made out to “Old Brookville Court” and remember to include your name as it appears on the ticket and ticket number. For Postal Money Orders, you must also have your address listed. In addition, please include a self-addressed stamped envelope so that I may return the paid receipts to you.
